Terms & Conditions

1.0 Introduction

Please take a moment to carefully review and understand the following terms and conditions before engaging in any contractual, agreement, or information exchange with the Writer operating under the name and style of Writers Path Consulting. These terms and conditions are legally binding and cannot be altered by any instructions or means other than through a written agreement signed by the Team Lead on behalf of Writers Path Consulting.

2.0 Nature of Contract

Any contract entered into with a client is a direct agreement between the client and the team lead under the business name Writers Path Consulting. Rights and obligations cannot be transferred to any third party. The relationship between a client and the business is that of an independent contractor. Writers Path Consulting does not, and will not, represent itself as an employee, partner, agent, worker, or representative of the client. This implies that our services are limited to the specific project at hand, including any necessary extensions required within the scope of the project.

3.0 Briefing and Instructions

The clients are expected to provide detailed instructions applicable to the work via email or any other agreed-upon channel with the Team Lead. The writer will assess these requirements and inform the client whether the work can be delivered as instructed and within the agreed timeframe. Instructions typically cover the topic, case study, writing style, reference formats, word count or page length, and other relevant details.

4.0 Pricing and Payments

The pricing for each project is determined based on the specific requirements, instructions, timeframe, and other relevant factors. Upon receiving the client's instructions, Writers Path Consulting, through the Team Lead, will communicate the fees for that particular project. It is important to note that any changes made by the client to the initial brief and instructions may result in upward adjustments to the fees.
Before commencing any work, clients are required to make a non-refundable deposit of 60% of the agreed project cost to an account designated by the Team Lead on behalf of Writers Path Consulting. The remaining 40% will be invoiced when the work reaches its halfway point, and the full work will be delivered to the client only after the balance is received by the Team Lead. In cases involving large projects, payments can be staggered and will be made in accordance with agreed project milestones. All payments must be made electronically, with proof of payment sent to the Team Lead within 24 hours of the transaction.

5.0 Commencement of Work

Work will not commence until the client has made the initial 60% non-refundable deposit, and has sent an email or any other agreed channel of communication confirming the payment, indicating their understanding and acceptance of the terms, conditions, and warranties contained herein, as well as their authorization for Writers Path Consulting to begin the work, and agreement to the fees. Once these conditions are met, the project is considered initiated, and the timeline begins.

6.0 Timescale, Milestones, and Deadlines

Writers Path Consulting recognizes the importance of delivering work on or before agreed-upon deadlines and will make sincere efforts to meet these deadlines. In rare cases where a deadline cannot be met, the Team Lead will inform the client as soon as possible, and adjustments to the timeline may be negotiated. It is essential to understand that the business and the Team Leadare not liable for any missed deadlines or penalties incurred by the client or any third party.

7.0 Termination of Contract and Pause Clause

If a client wishes to terminate an ongoing project, after work has commenced but before completion, they will forfeit the initial deposit and may be required to pay additional fees based on the extent of work already completed. Termination must be conveyed via email or the current means of correspondence between the client and the Team Lead.
An ongoing project is considered abandoned and implicitly terminated if a client fails to respond to communication within 15 working days after making the non-refundable deposit. Failure to provide feedback or data in accordance with the writer's requests or project milestones will result in the work being deemed "paused" and may be rescheduled based on availability and workload. If a client fails to provide feedback or data for more than 30 days, the project will be terminated.

8.0 Revisions, Corrections, and Allowable Adjustments

Clients are entitled to two (2) revisions for a given work. The writer will implement the client's feedback during these revisions. However, if revisions involve changes to topics, variables, case studies, work volume not initially specified, chapter outlines, or work structure agreed upon by the client, additional fees will apply. The two allowable revisions must be requested within the first 35 days after the work has been completed and delivered. Any revisions requested beyond this period or after the two allowable revisions will incur additional fees based on the extent and nature of the changes. For journal papers with extended review periods, timely notification is necessary, at least 10 working days before the 35-days limit, to be eligible for revisions.

9.0 Errors and Omissions

Writers Path Consulting will ensure that all works are thoroughly proofread and meet grammatical and factual accuracy standards. However, this does not guarantee that all works are completely free from typographical, grammatical, or factual errors and misconstructions.

10.0 Copyrights, Plagiarism, and Claims

Writers Path Consulting guarantees that all produced works adhere to copyright laws and pass plagiarism tests. The facts and statements contained in the work are, to the best of the writer's knowledge, accurate at the time of completion. However, clients must take responsibility for verifying the authenticity of the work. Writers Path Consulting and its Team members are not liable for any claims arising from copyright breaches or damages resulting from work done for a client. This applies to all works completed prior to the issuance of these terms and conditions.

11.0 Completion and Closure of Works

A work is considered completed when the client's instructions have been fulfilled, the work has been delivered, and the 40% balance has been paid. After completion, if the allowable revision period has elapsed, or revisions have been addressed, the work is considered closed. If the 40% balance is not paid within 7 working days of work completion, and no payment plan or acceptable mode of payment is communicated within the following 7 days, an additional fee of 2% of the total agreed fee for the work will accrue for every additional 10 days.

12.0 Intellectual Property Rights and Indemnification

Upon completion of the work, all copyrights are transferred to the client. However, the Team Leadon behalf of Writers Path Consulting reserve the right to use extracts of the work in their portfolio or marketing. The client agrees to indemnify Writers Path Consulting, the Team Lead, and any writer against actions or damages resulting from the client's use of the services provided.

13.0 Changes to Terms

The business reserves the right to modify or update these Terms at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the revised Terms.

14.0 Entire Agreement

These Terms constitute the entire agreement between the Client and the business and supersede any prior agreements, written or oral.
